Federal Strategies to Improve Legal Action of the Mexican State on Illegal Activities in the Maritime Field
Abstract
The general objective of this research was to formulate federal strategies of the Mexican state to improve legal action against illicit activities in the maritime field. The sample was represented by the personnel of the Legislative and Judicial Power, National Maritime Authority, Secretariat of the Navy (SEMAR), Jurists in International Maritime Law, authorities related to the maritime field and international specialists.
The research was based on the Resource- and Capability-Based Theory, following a qualitative approach and evaluation design. Furthermore, the data was collected using bibliographic records, documentary analysis and interviews. The PESTEL Analysis, Resource- and Capability-Based Theory and mainly SWOT techniques were used for information processing, results are presented and detailed through spreadsheets and matrices.
As conclusion, the federal strategies that the Mexican state requires to improve legal action against illicit activities in the maritime field are: the interaction of the legislative power, judicial power and Secretariat of the Navy - Mexican Navy’s (SEMAR) courses of action focusing mainly on the specialized training of judicial and legislative personnel related to maritime issues; the development of a consensual legal doctrine; and the creation of maritime courts and tribunals for the effective use of this specialized human capital.
